Witherspoon, infuriated at this unfortunate mishap, flung himself against the rebel charging line, which had taken advantage of the ' break, ' and a hand to hand encounter followed. Corporal Pat Sands, who, it will be remembered, was outlawed for breaking a man's nose while on veteran furlough in Detroit, singled out his man, and both raising their pieces, fired, and though within ten feet of each other, missed their mark.
